JOHN DRAGO & ASSOCIATES INVESTIGATIONS CIVIL/CRIMINAL JOHN DRAGO & ASSOCIATES CA PI LIC. # 14905 FEE RETAINER AGREEMENT & INVESTIGATION CONTRACT It is the policy of John Drago & Associates, the investigative firm to require each client to sign a written retainer agreement before beginning any work on a client's case. If you wish to have John Drago & Associates work on your case, and you agree to the terms that are set out below, please sign this agreement where indicated and return it to our office with the initial retainer fee of $1,500.00. The terms under which John Drago & Associates will work your case set out below: This agreement is made on ________________, 20__between________________ and John Drago & Associates. We will conduct investigative activities consisting of :______________________________________________________________________ These investigative activities will begin on or about ____________________________ 20__, following payment of the initial retainer and signed copies of this contract. The initial retainer fee of $1,500.00 is due from the client prior to commencement of services. We agree to conduct investigative activities, chargeable against the retainer at a rate of $75 per hour and $0.50 per mile, and all other expenses required by the investigation. We will prepare a report, testify in court, if needed, and provide a detailed invoice reporting all charges and expenses. No further investigative activities are authorized without prior written or oral approval by the client. This approval may be transmitted via fax to (650) 738- 9867. The client assumes responsibility to provide accurate information concerning the investigation. John Drago & Associates is not responsible for unproductive investigative time spent resulting from inaccurate information supplied by the client. The client agrees that additional activities of John Drago & Associates will be paid by the client at a rate of $75 per hour to include meetings, conferences, and court appearances. Unless waived herein by the client, John Drago & Associates agrees to provide within 15 days of the conclusion of the investigation services contracted herein, a written report and invoice accurately detailing the hours worked, activities fully accounting for time charged, and the results of the investigation. (Client's Initials)_____ The client waives the right to receive a written report. In addition to the hourly rates charged against the retainer, the client will be responsible for all costs, disbursements, and expenses incurred on your behalf. These costs include but are not limited to: Photocopying expenses, postage, travel, and lodging expenses. Should John Drago & Associates be required to bring suit or otherwise spend time trying to collect the amounts due, John Drago & Associates under this agreement, the client will also be responsible for our court costs and reasonable attorney's fees as determined by the court. The cooperation of the client is very important. Please notify John Drago & Associates immediately of any changes of address, phone numbers, etc. At our discretion, John Drago & Associates has the right to withdraw from the case if the client has misrepresented or failed to disclose material facts to John Drago & Associates, or if the client fails to follow our advise. Likewise, the client may discharge John Drago & Associates at any time for any reason. Unless the right to a written report was waived, the client will be sent a copy of the completed case report, which will constitute the client's copy of the file. Duplicate copies of the case report will be made available to you at your expense. Copies of all case materials (documents, photographs, video, or audio tapes) will remain in our files for such a period as required by law. You acknowledge being advised that John Drago & Associates cannot make guarantees regarding the ultimate outcome of this or any case, and that any questions relative to such matters are only our opinions. This agreement together encompasses all of the terms of the financial arrangement between the client and John Drago & Associates, and cannot be modified, except in writing, signed by both parties. THIS IS A LEGAL, BINDING CONTRACT BETWEEN YOU, THE CLIENT, AND JOHN DRAGO & ASSOCIATES. NO PROVISIONS HEREOF SHALL BE CONSIDERED WAIVED OR AMENDED EXCEPT IN WRITING BY BOTH THE CLIENT AND JOHN DRAGO & ASSOCIATES. WE AGREE THAT IF THERE IS ANY TERM HEREIN THAT IS DEEMED ULTIMATELY TO BE UNENFORCEABLE, THAT SAID TERM OR TERMS SHALL BE SEVERED AND THE REMAINDER OF THE AGREEMENT PERSUANT TO CALIFORNIA STATE LAW CONTINUE IN FULL FORCE AND EFFECT. BEFORE SIGNING, PLEASE READ THIS AGREEMENT CAREFULLY AND BE SURE YOU UNDERSTAND ALL OF THE CONTENTS. IF THERE IS ANYTHING YOU DO NOT UNDERSTAND, PLEASE ASK US ABOUT IT.
